This Technical Regulation defines the necessary requirements for chemical products issued at the customs territory of the Eurasian Customs Union and aims at the safety of life or health of citizens, property, protection of the environment, life and health of animals and plants, and also at prevention of the actions misleading the consumers.

It will come into operation on June 2, 2021

PRODUCTS TO BE CERTIFIED IN ACCORDANCE WITH TR EAEU 041/2017
All the chemical products imported to the customs territory of the Union
TR EAEU 041 DOES NOT APPLY TO:
- Chemical products intended for academic research works and/or that are the result of academic research and/or development works;
- Fossil fuels in the state of occurrence and the following products in case they were not chemically altered: minerals, ores, ore concentrates, cement clinkers, natural gas, liquefied gas, gas condensate, technological gas and its components, dewatered, desalted, and stabilized oil, oil-dissolved gas, carbon, charred coal;
- Pharmaceuticals and veterinary pharmaceuticals;
- Perfumes and cosmetics;
- Chemical products that are a source of radioactive emission (including waste of such products) regarding classification, marking and informing about radioactive emissions danger;
- Food products including nutritionals to the food and ready-made food for animals.
- Products that are included in items which do not alter their chemical composition and aggregate state, are not exposed to processes of destruction and oxidizing, are not a cause of dust, vapors or aerosols that may contain chemicals that could be dangerous for life and health of humans, life and health of animals and plants, environment and property during the use of such items at the territory of the Eurasian Economic Union;
- Chemical industry and consumption waste in case it’s subject to utilizing (recycling).
- Chemical products that come under the action of procedure of customs transit through the customs territory of the Eurasian Economic Union.
APPROVAL FORMS
TR EAEU 041/2017 assumes two approval forms:
- NOTIFYING STATE REGISTRATION
- APPROVING STATE REGISTRATION
WHO CAN APPLY?
The foreign manufacturer can apply for certification only through the Customs union residential company. It means that a Russian, Kazakh or other CU country’s company should bear responsibility for the products quality on the base of Local representative agreement. It can be the importer, distributor of the product or any other company located in the CU that will agree to act as a Local Representative.
