THE TECHNICAL REGULATION OF THE CUSTOMS UNION 009 “ON SAFETY OF PERFUMES AND COSMETICS” (TR CU  009/2011)

This Technical Regulation defines requirements for products and for industrial processes connected with these products aiming at protection of life or health of citizens, property, protection of environment, and prevention of the actions misleading the consumers.


Required for several industries and products

It came into operation on July 1, 2012

VALID IN Russia, Belarus, Kazakhstan, Armenia, Kyrgyzstan

EUROPEAN ANALOGUE – REGULATION (EC) No. 1223/2009

PRODUCTS TO BE CERTIFIED IN ACCORDANCE WITH TR CU 009/2011:

Perfumes and cosmetics in consumer packaging;

TR CU 009/2011 DOES NOT APPLY TO:

  • Products intended for swallowing, inhalation, injection or implantation into the human body;
  • Products for tattooing applied with skin distortion;
  • Products intended for diagnostics and disease cure.

LIST OF PRODUCTS THAT ARE SUBJECT TO STATE REGISTRATION IN ACCORDANCE WITH TR CU 009/2011:

  • Perfumes and cosmetics for artificial tan;
  • Perfumes and cosmetics for skin whitening;
  • Cosmetics for tattooing;
  • Intimate cosmetics;
  • Perfumes and cosmetics of individual skin protection from the impact of harmful industry factors;
  • Children cosmetics;
  • Perfumes and cosmetics for hair chemical dyeing, lightening and highlighting;
  • Perfumes and cosmetics for hair chemical curling and blow-out;
  • Perfumes and cosmetics manufactured with the use of nanomaterials;
  • Perfumes and cosmetics for depilation;
  • Peeling products;
  • Fluorine-containing oral hygiene products, fluorine weight percentage of which exceeds 0,15% (for liquid oral hygiene products – 0,05%);
  • Products for teeth whitening that contain hydrogen peroxide or other components that emit hydrogen peroxide including carbamide peroxide and zinc peroxide with the concentration of hydrogen peroxide (either as an ingredient or emitted) 0,1%-6,0%.

APPROVAL FORMS

TR CU 009/2011 assumes two approval forms:

  • THE DECLARATION OF CONFORMITY
  • THE STATE REGISTRAION CERTIFICATE

WHO CAN APPLY FOR CERTIFICATION?

The foreign manufacturer can apply for certification only through the Customs union residential company. It means that a Russian, Kazakh or other CU country’s company should bear responsibility for the products quality on the base of Local representative agreement. It can be the importer, distributor of the product or any other company located in the CU that will agree to act as a Local Representative.

POSSIBLE APLIED VALIDITY

The DoC / SRC can be issued for a batch (one consignment) or for serially produced products. The maximum applied validity of the DoC is 5 years. SRC is termless.

TIMING

The process lasts from 1 week to 3 months depending on certification scheme (certification for hazardous facilities or not) and the form of approval (DoC or SRC).
