Communication means (RADIO & TELECOM)

WWBridge overview of the main requirements for telecommunication products (FAC) and Radio-Frequency means (RF), procedures, approval documents and lead timing.

Radio and telecommunication devices are the most fast-growing imported products nowadays. Such products usually require several approval documents from different government certification authorities in order to be successfully imported to Russia, Belarus, Kazakhstan, Armenia, Ukraine, and other CIS countries.


The telecommunication products can be considered as various entities:

AS ELECTRICAL PRODUCTS

Here we should refer to the main regulative documents in the branch of certification of electronic devices.
These documents are the following:

  • Technical Regulation of the Customs Union (TR CU) 004/2011 "On safety of low-voltage equipment" (LVD)
  • Technical Regulation of the Customs Union (TR CU) 020/2011 "Electromagnetic compatibility of technical means" (EMC)
  • Technical Regulation of the Eurasian Economic Union (TR EAEU) 037/2016 "On restriction of the use of hazardous substances in electrical products and electronics" (ROHS)
According to the above-mentioned regulations the Declaration of Conformity or Certificate of Conformity can be required.

These legal acts are valid at the whole territory of Eurasian Economic Union - EAEU (former Customs union - CU). After the certification process is completed the EAC mark can be applied to the product.

AS TELECOMMUNICATION PRODUCTS

The devices that can be connected to the Public Telecom Network (PTN) must be certified in accordance with the requirements of Federal Agency of Communication (FAC) described in Telecom Law #126 -FL dated on July, 2003.

That is, these are the products that use Bluetooth (BT), Wi-Fi, wired Ethernet connection, GPS and LTE data transmission technologies. But here we should note that the main determining characteristic is the opportunity to be connected to the PTN. For example, some wireless BT headphones can be connected only to the music home-station or to the music player in a car (in other words - to the systems located nearby) so these products can be classified as the ones with no PTN access.

In this case, Telecom approval is not required.

Generally, the Telecom approval assumes two possible forms: Telecom (FAC) Declaration or Telecom (FAC) Certificate of conformity.

AS DEVICES INCORPORATING MEANS OF ENCRYPTION

Most radio and telecommunication devices have encryption capabilities. Here in the Eurasian Economic Union (EAEU) such products should have special approval from Federal Security Services (FSS or FSB). The FSS Notification should be issued in order to import such products to EAEU countries.

FSS highlighted the List of products that must be approved through FSS Notification in case of confirmed encryption facilities (article 2.19 of the «Non-tariff regulated product list»):

  • Pocket machines for recording, playback and visualization of data with computing features;
  • Printers, copy machines, facsimile ( fax ) machines and their electronic modules;
  • Pocket computers;
  • Computing machines (including personal computers (PC) and industrial ones) and their parts;
  • Pocket PC electronic modules;
  • Subscriber communication devices;
  • Base stations (docking stations);
  • Telecommunication equipment and its parts;
  • Hardware for broadcasting and television;
  • Radio navigation receivers, remote control hardware;
  • Equipment that provides access to information and communications network “Internet” and television receivers with communication function, their parts;
  • Integrated electronic circuit chips, storage devices etc.

The FSS Notification can be issued for 5 years or longer. The process is described in the article “The FSS Notification (Encryption approval)”.

AS RADIO PRODUCTS

IT industry products usually transfer data using wireless technologies. So they need to use a certain frequency band for this purpose. Some radio devices can be freely imported (with no radio approval). Mostly these products are:

  • Radio stations operating in the radio frequency band of 433.075 - 434.775 MHz, with an output power of the transmitter not exceeding 10 mW;
  • Transmitting equipment including a receiving device of a short range of the IEEE 802.15 (Bluetooth) standard operating in the radio frequency band of 2400 - 2483.5 MHz, with an output power of the transmitter not exceeding 100 mW, including the built-in parts or being part of other devices;
  • Terminal (subscriber) transmission equipment including a receiving device of short range of IEEE 802.11, IEEE 802.11.b, IEEE 802.11.g, IEEE 802.11.n (Wi-Fi) standards operating in the radio frequency band 2400 - 2483.5 MHz with an output power of the transmitter not exceeding 100 mW, including the built-in parts or being part of other devices;
  • Terminal (subscriber) transmission equipment including a receiving device of a short range of the standard IEEE 802.11.a, IEEE 802.11.n (WiFi) operating in the radio frequency bands of 5150-5350 MHz and 5650-5572 MHz with the transmitter output power not exceeding 100 mW, including the built-in parts or being part of other devices;
Etc.

It is relevant for all EAEU countries. But there might be some exceptions for certain products. 

If the applied product uses another radio-frequency band and has a higher transmitting capacity, radio approval must be obtained. The radio approval system is not harmonized in the EAEU countries that mean that each destination country can be its own requirements and approval form. For example, in Russia sphere is regulated by Radio-Frequency Center (RFC) which issues the RFC Conclusion for radio products that allowed for import to the territory of the Russian Federation.
